This notice explains how Kkomal Vasisht, sole proprietor, trading as TheGemSure ("we", "TheGemSure") handles your personal data when you use thegemsure.com. We are the Data Fiduciary under the Digital Personal Data Protection Act, 2023 (DPDP Act). We collect only what we need to sell and deliver your order and to answer you.
What we collect and why
- To deliver your order: name, phone number, email, delivery and billing address, the items you buy. Needed to make the contract with you; without it we cannot ship.
- To take payment: payment is handled by Razorpay. We see the payment status and reference, the method (for example "UPI") and, for cards, only the last four digits. We never see or store your full card number, CVV or UPI PIN.
- For your account (optional): phone and/or email, a password stored only as a one-way hash, your saved addresses, wishlist and reviews.
- To answer you: what you write to us by email, WhatsApp, the contact form or a return request, and photos you send.
- To keep the site working and safe: your IP address, browser type and the pages you visit, kept in our own server logs to stop fraud and abuse and to fix errors.
- Newsletter (only if you ask for it): your email, to send offers and new arrivals. Write to us at any time to stop them.
We do not collect sensitive data such as your date of birth or horoscope unless you choose to give it to us in a message, and we do not sell personal data to anyone.
Cookies
We use a few cookies of our own: one to remember your basket (tgs_cart), one to keep you signed in (tgs_session) and one anonymous visit counter (tgs_v) for our own statistics. We do not use advertising cookies, Google Analytics or Facebook tracking. Blocking cookies in your browser will empty your basket and sign you out, but the site still works.
Who we share data with
Only with those who need it to complete your order, under their own legal duties of confidentiality:
- Razorpay Software Pvt Ltd — payments and refunds;
- Shiprocket (BigFoot Retail Solutions Pvt Ltd) and the courier it books — your name, phone and address, to deliver the parcel;
- our email and SMS providers — to send order and delivery messages;
- Hostinger — the servers the site and its database run on;
- government authorities, courts or police, only when the law requires it.
How long we keep it
- Order and invoice records: as long as tax and accounting laws require — currently up to 8 years.
- Account data: until you ask us to close the account, then deleted within 30 days except what the law requires us to keep.
- Messages, return photos and server logs: only as long as they are needed to settle the matter, keep the site secure or meet a legal duty.
Your rights
Under the DPDP Act you can ask us to:
- tell you what personal data we hold about you and who we have shared it with;
- correct, complete or update it;
- erase it, where we no longer need it for the purpose or the law;
- withdraw consent you gave (for example to the newsletter) — as easily as you gave it;
- nominate someone to exercise these rights if you die or become unable to;
- hear your grievance.
Write to our Grievance Officer at support@thegemsure.com. We reply within 48 hours and act within 30 days. If you are not satisfied, you may complain to the Data Protection Board of India.
Security
The site runs only over HTTPS. Passwords are hashed, admin access is protected by password and optional two-factor sign-in, and the database is backed up every night. No system is perfectly secure; if a breach affecting your data ever happens, we will tell you and the Data Protection Board as the law requires.
Children
The site is meant for adults. We do not knowingly collect data from anyone under 18; if you are under 18, please ask a parent or guardian to order for you.
Changes
If we change this notice, the new version appears here with a new date. For a significant change we also tell account holders by email.
